A concern stole one of my photograph and published in their brochure.I send them a mail regarding copyright violation,they gave me the mob number of that guy who made this work..after ranging him,he roughly told me that he took the copyright of this four years ago...Is it possible..can anybody take copyright of my shot without my permission? and what should I do now? SUBIR

Ask the thief to produce the exif file.
If the image is stolen from TrekEarth he won’t be able to do so as the exif file is stripped from the image upon upload to TE. Good luck! |

They ask to send donations at the name ISKCON... also known as the Hare Krishna movement... Contact the Mayapur website in question and tell them what you want... be it money, removal (or both if you can!) as they are based in India... Good luck too! Laurent |

Unless you made a mistake when you uploaded the image to TE the date you took it states 14/01/2008. That means there is no way he had the copyright for 4 years as the photo didn't exist then. If you have the original image you can threaten him with legal action and make demands as Laurent suggests.

The response you got over the phone (being lied to) is just more evidence that they have stolen your image willfully .... with intent to misuse and with full knowledge that what they are doing was not doing is legal ... the answer to your question is no you cannot "give away" your copyright .. and in the US anyway the amount of damages you can collect centers around whether the violation was "accidental" or "willful" (in which case punitive damages far beyond the actual value can be awarded) .. rattle your saber ..

Hello Te friends,
One protective move on pictures posted on TE is to depict a name or signature of photographer in the Bottom-left or right of picture ( like I do lately ). As for the case presented above , it is up to the ligal system in his country , with a good lawyer to take this case.However , if the picture was posted elsewere than TE I would not know how a copy can be followed and protected.
